Please read these Terms of Service ("Terms", "Terms and Conditions") carefully before using the OddsBank website, chrome extensions, or app (the "Service") operated by OddsBank Pty Ltd ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Account

In order to access certain features of our service you must have an account (free or paid). All account details must be accurate and up-to-date at all times.

By opening an account you are confirming that you are 18 or older.

Your account password should be unique to you and should be protected at all times, it should never be disclosed to a third-party. If you are aware of any unauthorized use of your account you must notify us immediately.

If we suspect that any user is sharing their log-in details with a third-party we reserve the right, at our sole discretion, to terminate their account without notice or refund.

Payments and Refunds

All of our paid memberships operate on a subscription basis. They are billed in advance and automatically renew on a monthly basis.

If you wish to cancel you can do so at anytime. However, no refunds will be given for any unused time on your subscription.

If you have set up a recurring payment through Stripe or any other method it is your responsibility to cancel that payment through your account settings.

Requests for refunds of recurring payments when a member has forgotten to cancel, or when they did not realise the payment was recurring, will be automatically granted if made within 48 hours of the transaction. However, a 10% admin fee will be applied to cover the costs incurred with our payment processor.

Software

OddsBank provides software that collects and displays odds data for a range of bookmakers, sports, leagues, and markets. While we endeavour to have this data as complete and accurate as possible at all times, there will inevitably be times when certain data is not available or is inaccurate.

It is the responsibility of members to confirm the accuracy of data before placing any bets. OddsBank bears no liability for bets placed as the result of incorrect data on our software.

Furthermore, no refunds will be given on the basis that a certain bookmaker, sport, market, or league is temporarily unavailable on our software. Members accept that, due to the nature of the technology, occasional downtime is always a possibility.

By using our software, including any chrome extensions or apps, you agree not to:

• bypass any measure we may use to prevent or restrict access to the service, or otherwise attempt (by any means) to gain access to data or information that you are not entitled to access.
• copy, modify, create derivatives of, decompile, or reverse engineer the service or take any action to interfere with OddsBank's proprietary and intellectual property rights.
• interfere with or disrupt OddsBank or the servers or networks connected to OddsBank.

Intellectual Property

All intellectual property and trademark rights in OddsBank shall be owned by OddsBank Pty Ltd absolutely and in their entirety. These rights include, but are not limited to, database rights, copyright, design rights (whether registered or unregistered), trademarks (whether registered or unregistered) and other similar rights wherever existing in the world together with the right to apply for the protection of the same (the "Intellectual Property"). All other trademarks, logos, service marks, company or product names set forth on OddsBank are the property of their respective owners.

You agree that you will not use OddsBank's Intellectual property for any purpose except to the extent necessary to be a user of the OddsBank services. If you create any materials using the OddsBank Intellectual Property, you agree that upon their creation OddsBank exclusively owns all right, title and interest in and to such materials, including without limitation any modifications to the Intellectual Property or derivative works based on the OddsBank Intellectual Property. You further agree to assign any interest or right you may have in such materials to OddsBank, and to provide information and execute any documents as reasonably requested by OddsBank to enable us to formalise such an assignment.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Links To Other Web Sites

Our Service may contain links to third­-party web sites or services that are not owned or controlled by OddsBank. OddsBank has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services.

You further acknowledge and agree that OddsBank shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Disclaimer

Our service provides odds comparison data to help users make informed betting decisions, however the decision to place any individual bet lies solely with the user. OddsBank cannot be held responsible for any losses incurred for any reason including, but not limited to, user error, OddsBank error, bookmakers refusal to pay, or inaccurate odds data.

OddsBank is a comparison service only and does not provide gambling or betting advice. Users are solely responsible for their betting decisions and activities.

Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
